Drunk Driver Suspected in Fatal Texas Car Accident

A Texas Tech student, who admitted to consuming five beers and a shot of rum before getting behind the wheel, has been indicted for intoxication manslaughter, intoxicated assault and aggravated assault following a fatal car accident on October 22.

According to Texas police, the student was speeding on a Lubbock downtown street at approximately 80 mph when she rear-ended an SUV, causing the SUV driver to be ejected from the vehicle. The victim was killed instantly, while other passengers in the SUV suffered serious car accident injuries.

Investigators say that the student's blood alcohol content (BAC) was .25 at the time of fatal car crash. The 21 year old allegedly drank while returning to Texas after visiting New Mexico for an engineering class field trip. Texas Tech stated that it would be inappropriate for the university to comment until the entire investigation into the accident is complete.

Texas Car Accidents Caused by Drunk Drivers

This tragic car accident is just one of the hundreds of accidents caused by reckless drivers who drink and drive. In 2009, 956 individuals lost their lives in DUI and alcohol-related crashes throughout Texas, according to the Texas Department of Transportation. While major law enforcement initiatives have aggressively targeted drivers under the influence of drugs or alcohol, the number of fatal car accidents remains high.

Families of victims killed in fatal DUI crashes do have recourse against drunk drivers. Texas law allows loved ones to file a wrongful death suit against the at-fault driver. Compensation for pain and suffering, medical costs, funeral expenses and lost wages may all be recovered through a wrongful death suit. In certain circumstances, victims' families may also be entitled to punitive damages, which are meant to punish an at-fault person.

After a fatal accident, a Texas wrongful death attorney can help evaluate the strength of a wrongful death suit and assist a grieving family in seeking legal recourse.
