Fatal accident kills 20-year-old female in pickup rollover crash

Once a vehicle goes out of control on a highway its movements can't be predicted. When it hits an object, people can be ejected and thrown for distances into the air and the vehicle itself can ricochet and tumble in all directions. In an Aug. 24 fatal accident in Texas, the driver of a Dodge Ram pickup lost control on Loop 375 near Railroad Drive in Northeast El Paso. Police believe that the vehicle was speeding eastbound on Loop 375, and when the driver lost control it hit the concrete median barrier and flipped high enough in the air to cross over the barrier and tumble into the westbound lanes.

A 20-year-old female passenger from Anthony was partially ejected and killed. Three others were injured. They were two male soldiers from Fort Bliss and a civilian woman. They were taken to University Medical Center for treatment with non-life-threatening injuries. El Paso Police investigators are working with Fort Bliss officials to try and figure out what caused the fatal accident.

The driver of the pickup was hospitalized shortly after causing the wrongful death incident. Police stated that the 22-year-old of East El Paso will be charged with intoxication manslaughter. Police believe he was drunk and was speeding. El Paso police were waiting for the driver to recover enough to book him into the El Paso County Detention Facility. Due to the place and circumstances of the accident, the military base will relinquish jurisdiction over the crash to civilian authorities.

Under Texas law, negligence principles apply to the civil side of this fatal accident. Because the driver was at least negligent in losing control of the vehicle and allowing it to crash into the median barrier, he is in all likelihood the at-fault party. Barring utterly unforeseen facts coming to light, the driver is liable for civil damages to the passengers injured. He's also liable to the estate of the deceased woman for wrongful death damages.
