Wrongful death claims possible after fatal pedestrian accidents

Sadly, two individuals in Texas lost their lives in auto-pedestrian accidents earlier in February. These types of accidents are, unfortunately, common across the state, and the results leave surviving family members struggling in a number of ways. Those who have lost a loved one in a fatal pedestrian accident are not alone, and wrongful death claims may possibly be filed in an effort to seek compensation for any damages suffered as a result.

Two people were killed in two separate accidents earlier this month in the eastern part of the state. An 84-year-old male died after finishing his shift as a school crossing guard. According to reports, a driver failed to stop at a traffic signal and struck another vehicle which, ultimately, hit the victim who was standing on the sidewalk. That same morning, an 18-year-old female was struck by a car while she was walking to school.

Each accident is still under investigation. At this time, it is unknown if any charges will be filed in either case. While speeding is believed to be a general issue at the locations of these accidents, it is unknown if that was a contributing factor in either of these incidents.

The surviving family members of each victim may file a wrongful death claim against the party/s believed responsible for the fatal accident. If negligence is properly established in a Texas civil court, claims that are successfully litigated may be awarded a monetary judgment to compensate for the economic losses suffered. Taking this legal step can grant each victim's family the ability to mourn their loss without having to worry about finances and can provide some sense of closure for such a tragic event.
