Texas car accident: Aggressive drivers, a threat to public safety

Drivers come in all forms. There are those who are super cautious, those who are easily distracted and those that are extremely aggressive -- among various others. At the end of the day, any of these behaviors, exhibited by drivers in Texas and elsewhere, can be considered threats to public safety. While there are a lot of things that can be said about all of the different driver types, today the focus will be on just one -- the aggressive driver -- and the legal action available to an individual who has been injured in a car accident as a result of this kind of behavior.

Aggressive driving may be defined a little differently from state to state. However, on a national level, this type of behavior is typically defined as traffic violations that place others in danger or may cause damage to property. Some such behaviors include:

  • Speeding
  • Improper lane changes
  • Failure to maintain a safe following distance
  • Failure to properly signal
  • Failure to obey all traffic signs/signals

Aggressive driving is not to be confused with road rage. While a person who is accused of road rage may commit all of the violations listed above, this person will also be accused assaulting another person or persons with his or her vehicle or other weapon. Depending on the circumstances, those accused of either of these behaviors typically face serious criminal charges.

Aggressive driving can be seen everyday on Texas roads. This type of behavior can, and does, result in vehicular collisions. An individual who has been injured in a car accident by an aggressive driver may have legal recourse. Personal injury claims may be filed in civil court against the individual deemed responsible. Fair and full compensation for any recoverable damages may be achieved through successful litigation.
