After a fatal accident surviving family members may seek relief

Sadly, fatal accidents occur rather frequently in Texas. When they do, it is understandable for surviving family members to question what -- if any -- relief is available to help cover their losses. After a fatal accident, a victim's loved ones may pursue damages through filing a wrongful death claim.

A wrongful death lawsuit is a claim that is filed in civil court. After the death of a loved one, if any form of negligence is suspected in contributing to the loss of life, surviving family members may seek relief for any damages sustained. These may include:

  • Lost wages and benefits
  • Lost companionship
  • Funeral expenses

Establishing negligence in a wrongful death claim is not always easy, as these cases sometimes require quite a bit of investigation before they are brought to court. To be successful, such claims must consist of certain elements, which are the death of a person, negligence or intent to harm, and proof of monetary losses to the victim's family. If each of these elements exists and negligence can be established to the satisfaction of the court, compensation for any and all recoverable damages may be awarded.

Simply put, filing a wrongful death claim in Texas can allow surviving family members to seek relief that is often desperately needed following a fatal accident. While these cases can take time, in the end, if the individual believed responsible for the incident is found to have been negligent, monetary damages may be achieved. An experienced attorney will be able to walk a victim's family through every aspect of filing and litigating this type of claim and will work diligently to seek the best outcome possible for the client.
