What happens when a truck accident is caused by a medical issue?

Accidents involving semi trailers and other commercial haulers occur quite frequently in Texas and across the country. When a truck accident happens, it is common for a thorough investigation to take place. Truck drivers and trucking companies are highly regulated, so if any regulation issues or any other forms of negligence are found to have contributed to these accidents, victims may have legal recourse.

Federal regulations are in place to help keep drivers, employers and the general public safe. One thing that drivers must do, according to the Federal Motor Carrier Safety Administration (FMCSA), is submit to physical exams. These exams are to be completed at least every two years. Drivers who are found to have any medical concerns, such as blood pressure problems, may have to have physical exams completed more frequently.

The Department of Transportation (DOT) has certified specific medical providers to perform physical examinations. A full list of eligible providers can be obtained through the FMCSA. Not all providers are doctors of medicine; some are advanced practice nurses, physician assistants or even chiropractic doctors.

When a truck accident is caused by a medical issue, it is likely that the driver's physical exam information may be questioned. If a problem has been ignored, improperly treated or any other form of negligence is believed to have contributed to the accident, the driver and his or her employer may be held accountable. Victims or surviving family members may pursue civil actions in a Texas court in an effort recoup any damages sustained as a result of incidents.
