A Texas man recently lost his life when his motorcycle was struck by another vehicle. Police believe that this motorcycle accident was the result of both drunk and distracted driving. The individual deemed responsible for the wreck has been arrested and charged for the incident.
At the end of January, a man who was riding his motorcycle was struck head-on by a pickup truck in Hood County. This incident occurred on the FM 4 Loop 567. The victim was 53 years old. His wife witnessed the event, as she was on another motorcycle following behind her husband.
According to police, a 36-year-old woman was behind the wheel of the pickup. It is believed that she was traveling in the southbound lane and then drifted over the centerline into oncoming traffic. Investigators claim that she was driving while impaired and talking on her cell phone when the crash occurred. She has been charged with intoxication manslaughter.
It is a horrible thing to lose a loved one in such a tragic manner. The victim's wife is, undoubtedly, struggling with not only the loss of her husband but with having to watch the incident unfold. According to the state of Texas, she retains the right to seek damages for the physical, financial and emotional losses sustained as a result of this motorcycle accident. In order to do this, she could file wrongful death and survival action claims against the driver deemed responsible. While nothing can replace the life that has been lost, by taking legal action -- if litigation is successful -- the victim's loved ones may be able to achieve compensation and a sense of justice and closure following this terrible event.
