Who is to blame when an auto defect causes injury or death?

Vehicle recalls are reported quite frequently it seems. An auto defect can, if not properly and timely addressed, cause injury or even death. Who is to blame when this happens and where can Texas residents turn for help?

Auto defects come in many forms -- such design flaws, poorly made parts and other manufacturing errors or even due to damages to a vehicle during shipment. When a defect is discovered, auto manufacturers have a responsibility to the public to issue an official warning and offer repairs. If an auto maker fails to take these steps, the company may be held liable for any damages suffered by customers or any other individuals who have been negatively affected by the defect.

To file a claim against an auto maker and/or others in the chain of supply, it will be necessary to prove that the defect itself caused injury or death. A driver who used a vehicle beyond its intended purposed and resulting in an accident, for example, may not be able to successfully litigate a defect claim. Also, it is important that the vehicle not have been substantially modified from its original state, as it would be difficult to prove if the modifications or the defect was the true source of the problem.

Auto defect claims can be somewhat difficult to navigate, as there are a lot of factors that can contribute to accidents and injuries. Those in Texas or elsewhere who believe that they have been injured or lost loved ones due to the use of defective auto parts in their vehicles may have legal recourse. Product liability, personal injury and/or wrongful death claims may be filed in civil court with the assistance of an experienced attorney, in an effort to seek fair and full compensation from those believed responsible for any losses sustained.
