Kids in car add additional charges in bicycle accident

When someone drives carelessly, it puts others in danger on the road. However, when people drive negligently with minors in the car, especially children who are unrestrained and are under 11, charges for a resulting car or bicycle accident can escalate quickly. Recently, a Texas woman was charged with aggravated assault and child endangerment.

According to arrest documents, the incident happened at approximately 6:52 p.m. on a local street in Lufkin. When police arrived at the scene, the apparent victim told an officer he had been hit by a woman driving an SUV. He also told the officer that the person in question was still driving around the neighboring streets.

Police dispatch relayed to the officer on scene that the suspect had been in contact with her mother and asked that her mother pick up the children in her vehicle. Per the victim, the woman had followed him in her SUV, even crossing a home's yard in her pursuit. At that point, he claims that the driver struck the rear of his bicycle with her SUV. Following this, the woman reportedly drove the SUV into a large ditch.

The accident investigation showed that there were no child safety restraints present in the SUV, despite the children being 2, 4 and 10 years old. Arrest documents note that the children were not restrained during the accident and could have been seriously hurt if they were in the car when it went into the ditch. The woman was eventually charged with second-degree endangering a child and first-degree assault of a date or family member with a weapon charge.

Thankfully, innocent children were not harmed in this case. However, the bicyclist was taken to a local medical center to seek treatment for his injuries.
