Off-duty officer refused sobriety tests after fatal car accident

As human beings, everyone makes mistakes from time to time. However, when someone decides to pursue a career in law enforcement, they should expect that their personal choices and behavior will be held to a higher standard. When people hear accounts of an officer of the law engaging in illegal activity, it may be difficult to understand. In a recent Texas case, an off-duty police officer was allegedly inebriated when he was involved in a fatal car accident.

The accident occurred on Friday, August 12 around 6:30 a.m. on a local road in Fort Bend county. According to the county sheriff's office, the off-duty officer struck a sports car with his SUV at an intersection. From the investigation, it appears that the SUV driver had traveled into the other driver's lane, which caused him to collide with the Corvette.

The 36-year-old driver of the sports car was killed upon impact. When authorities arrived at the crash site, they stated that they smelled alcohol on the SUV driver. When it was requested, the man refused to submit to any field sobriety tests. Officers subsequently took him to a local hospital in order to obtain blood samples so they could check for the presence of alcohol or other substances.

At this time, no criminal charges have been filed as authorities are waiting on the results of the bloodwork that was acquired from the officer. However, the surviving loved ones of the deceased victim are still able to file a wrongful death lawsuit in Texas civil court in order to pursue financial restitution. There can be many unexpected expenses that occur after a fatal car accident, and an experienced personal injury and wrongful death attorney will be able to help grieving family members reclaim some or all of the expenses incurred.
