Woman sues Texas golf club for husband's wrongful death

With most car wrecks in which alcohol consumption is involved, the blame falls on the shoulders of the intoxicated driver. However, in Texas, laws can allow victims and loved ones to hold the establishment serving alcoholic beverages partially to blame in the event of an accident. Recently, a widow sued a prestigious golf club in Dallas, seeking damages for the wrongful death of her husband.

The accident in question occurred on a local road in Dallas at approximately 6:30 p.m. on October 8, 2015. A 32-year-old man was riding on his moped when he was struck from behind by a 23-year-old woman driving an SUV. The crash caused his vehicle to hit a sedan in front of him and resulted in his ejection from the cycle.

In addition to the moped and SUV, three other cars were involved in subsequent crashes as a result of the initial wreck. The moped driver was pronounced deceased at the scene. The driver of the SUV was charged with intoxication manslaughter by police at the time of the accident.

Per police reports, the SUV driver had to hold on to an officer in order to keep her balance while being questioned. She told officers, however, that she had just had one alcoholic beverage in the previous hours before the accident. The suit states that the driver was obviously drunk at the scene, and further alleges that the Golf Club of Dallas continued to serve her after it was apparent that she could be a danger to other drivers. The SUV driver was able to pay a $50,000 bail the morning after the accident.

Regardless of pending criminal charges, surviving family members facing similar accidents can pursue a civil lawsuit against both the drivers and potentially the establishments responsible. Most in these situations contact an experienced personal injury attorney in Texas who is experienced in wrongful death litigation. Attorneys who focus in this area of law will be in the best position to discuss the many legal options.
