Parents file suit against Apple for wrongful death of child

Technology has completely revolutionized the way people live their every day lives. While it can be an asset in many ways, there are times when new technology might pose a danger to others, especially when one considers the recent wrongful death civil suit that has been filed against a technology giant. The Texas family who lost their child claims that Apple is at least partially to blame.

The lawsuit came about after a tragic accident that occurred on a December night in 2014. The accident report indicated that the family of four was traveling along a Texas interstate when another vehicle crashed into theirs. The father and a 5-year-old daughter both suffered critical injuries. Emergency crews transported both for medical care, but the child did not survive.

The driver who was behind the wheel of the other car claimed he was not fully paying attention as he was using Apple's Facetime application on his phone at the time of the wreck. The family alleges that Apple should be held liable for the loss of their daughter since Apple allegedly possesses the technology that would have prevented this particular application from functioning when the user was operating a vehicle. The company purportedly filed for a patent in 2008 which was granted early in 2014, several months earlier to the tragic accident.

The Texas family claims that Apple allowed a defective product to be released to the public without proper notification of the danger the Facetime application may pose to drivers and without installing the new safety feature it had developed. While this case is unusual, it is the family's right to seek redress for the loss of their daughter and for the undoubtedly substantial monetary damages that likely accumulated after the crash. A wrongful death claim may allow families to recover financially while they focus on struggling to move forward in the aftermath of such a terrible tragedy.
