Texas woman's family files wrongful death lawsuit

Many Texas residents own a bicycle and use it for leisure or exercise or a bit of both. Some cyclists also like to participate in organized bicycling events from time to time, whether for charity or simply to have fun with other cyclists. However, occasionally, a participant in an organized event meets a tragic end. This is what happened to a Texas woman last summer, and her family has now filed a wrongful death lawsuit seeking more than $1 million in damages.

The accident happened last August when the 47-year-old woman was participating in a bicycling event. A vehicle veered onto the shoulder where she was riding, striking her, causing her to be thrown from her bicycle and ultimately killing her. The driver claimed the sun was in his eyes, but he was also found to be driving above the posted speed limit. He has been charged with one count of criminally negligent homicide. Apparently, the crash is still under investigation.

The deceased woman's family has now filed a lawsuit against several involved parties, including the driver, the owner of the vehicle and the organization that coordinated the cycling event. The family claim the driver was incompetent and the company he worked for was negligent as they failed to properly train and supervise the driver when they entrusted him with the company vehicle. As well, the lawsuit claims the organization that planned the event failed to enact proper safety protocols, including not checking the route carefully for potential hazards and not placing warning signs along the route for motorists and participants.

Sadly, a family is mourning the loss of their loved one, possibly due to the negligent actions of others. In any case in which it is believed an involved party's negligence has contributed to a person's death, the remaining family members may wish to seek legal counsel to discuss pursuing a wrongful death lawsuit in Texas civil court as this particular family has done. A successfully litigated case could help a family recoup monetary losses due to funeral costs, lost income and other expenses.
