FMCSA Hopes to Reduce Truck Accidents by Stopping Reincarnated Carriers

Austin motorists know how bad traffic can be in the city. Traveling on the interstate or other busy highways can be a challenging experience at many times of the day. With more cars and trucks on roadways, motorists rely upon one another to practice safe driving habits to reduce the risk of accident.

With larger vehicles like 18-wheelers, there are specific rules in place that have been designed to help improve motorist safety and reduce the number of serious trucking accidents across the United States. The Federal Motor Carrier Safety Administration (FMCSA) is the agency responsible for passing rules that apply to trucking safety.

One particular problem that the FMSCA had been struggling to address concerned what is commonly called "reincarnated carriers." These carriers are a huge issue for the trucking industry.

A reincarnated carrier is a company that comes into existence after a previous company is ordered out of service. Say, for example, a trucking company that had several safety violations and caused numerous truck accidents is ordered off of the road by the FMCSA until the company corrects the issues at hand. Well, the company could just close down, and then start up again with a different name, not addressing any of the agency's concerns.

This new rule allows the FMCSA to tie old punishments to the new companies, making it more difficult for a new entity to escape these sanctions. The penalties may attach to drivers or the companies, depending upon how the new company is structured.

The agency stated that this is only the first step in dealing with this troubling issue. By streamlining this review process, dangerous carriers may be held responsible for the for their safety violations.
